October 1-31, 2008 Sweepstakes Rules

No Purchase Necessary to Enter or Win. A purchase will not increase your chances of winning. The Comey & Shepherd Realtors Price Me Now Sweepstakes (the "Sweepstakes") begins at 12:00 a.m. (Pacific Time) on October 1, 2008, and ends at 11:59 p.m. (Pacific Time) on October 31, 2008 (the "Sweepstakes Period"). Sweepstakes is sponsored and hosted by Realius, Inc., located at 1654 Solano Unit A, Berkeley CA 94707 ("Sponsor"). Promotional consideration provided by Comey & Shepherd Realtors ("Promoter").

ELIGIBILITY. Sweepstakes is open to legal residents of the fifty (50) United States and Washington D.C. and who are at least 18 years of age or older as of the start date of the Sweepstakes ("Entrants"). This Sweepstakes is void outside of the United States, in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, all other U.S. territories and possessions, and wherever else restricted or prohibited by law. Employees, shareholders, officers, directors, agents, representatives of Sponsor, Promoter or the promotion and advertising agencies of any aforementioned entity, and their immediate family members and those living in their household, and each person or entity connected with the production or administration of the Sweepstakes, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity are not eligible.

HOW TO ENTER. Online only. Before entering, you will need an account at Realius.com. Access the website at http://comey.realius.com and register, providing the information requested. Realius.com registration is free and easy. During the Sweepstakes Period, go to http://comey.realius.com, register or sign in and play the PRICE ME NOW game (the "Game") to win Realius PropertyIQ points. You will need to guess prices of at least ten (10) different homes in order to be entered into the Sweepstakes. Realius PropertyIQ points are calculated by algorithm, based in part on your and other players? price guesses. Your Realius PropertyIQ points may change during the Sweepstakes Period, based on other players? guesses. Only Realius PropertyIQ points accumulated during the Sweepstakes Period will count toward your entry; existing Realius registered users as of the start date of the Sweepstakes may not use Realius PropertyIQ points accumulated prior to the start date of the Sweepstakes to enter the Sweepstakes. All entries must be received during the Sweepstakes period as determined by the computer time on Sponsor's server.

LIMIT ONE (1) ENTRY PER NATURAL PERSON PER EMAIL ADDRESS.

Sponsor is not responsible for late, lost, delayed, damaged, misdirected, corrupted, incomplete, illegible or unintelligible entries. Sponsor reserves the right to disqualify false entries or entries suspected of being false. Only complete valid entries will be accepted. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.

PRIZE: Three (3) Prizes: Gift certificate to Pitrelli's Itallian Cafe - $25 each for first and second place and a $10 for third place. No substitution, transfer, or cash redemption of prize, provided however that Sponsor reserves the right to substitute a prize with another prize of equal or greater value should the advertised prize become unavailable for any reason. Selected Entrant cannot assign or transfer their prize to another person or business. Actual value may vary. Selected Entrant not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. Selected Entrant is solely responsible for any and all federal, state, and local taxes on prize. All activities related to the prize are at the Selected Entrant?s own risk and subject to whatever restrictions are imposed by the entities that govern activities. Selected Entrant may be required to sign and return an Affidavit of Eligibility within seven (7) days of prize notification. Noncompliance with this time period will result in disqualification and selection of an alternate Selected Entrant. If prize or prize notification or any prize is returned as undeliverable, prize will be forfeited and an alternate Selected Entrant may be selected. Sponsor will not make multiple attempts to contact Selected Entrant.

SELECTION AND NOTIFICATION OF CHOSEN ENTRANT. Three (3) Entrants with the highest number of Realius PropertyIQ points at the end of the Sweepstakes will be eligible to win the prize ("Selected Entrant"). The Selected Entrants will be notified by phone and/or e-mail, in Sponsor's discretion, using the information provided on the original entry form. Selected Entrants will be required to respond (as directed) within 72 hours of attempted notification. The failure to respond timely to the notification may result in forfeiture of the prize and, in such case, Sponsor may randomly select an alternate Selected Entrant from among the remaining eligible entries. Selected Entrants may also be sent an affidavit of eligibility / liability / publicity release ("Release"). Selected Entrants must provide all information requested to be eligible to win. Unless restricted by law, each Selected Entrant will be required to complete and return the Release within the time period specified therein. The prize may be forfeited and, in such case, an alternate Selected Entrant may be randomly selected from among the remaining eligible entries if a Selected Entrant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. The first and last name, hometown and Realius username of Selected Entrant may be announced on www.realius.com and affiliated web sites on or around November 15, 2008.

ODDS. The odds of winning depend on the total number of eligible entries received.

CONDITIONS. Sweepstakes is subject to these Official Rules. By participating, Entrants agree: (i) to be bound by these complete Official Rules and the decisions of Sponsor which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Sweepstakes or these Official Rules, except where prohibited by law. By accepting a prize, Selected Entrant agrees to release Sponsor, its subsidiaries, affiliates, parent companies, directors, employees, officers, licensees, licensors and agents, including without limitation, its advertising and promotion entities and any person or entity associated with the production, judging, or administration of the Sweepstakes, (collectively, the Releasees) from any and all liability, loss or damage arising from or in connection with awarding, receipt and/or use or misuse of prize or participation in any prize-related activities. Releasees reserve the right to use the Sweepstakes for publicity purposes in any media, and to use the first and last name, likeness, hometown name, Realius user information and/or prize information of Selected Entrant as part of that publicity, without any compensation or prior review unless prohibited by law. Entrants shall release Releasees, and Sponsor shall not be liable for: (i) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (ii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iii) any injuries, losses or damages of any kind, including death caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Sweepstakes; or (iv) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes. Sponsor disclaims any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Sweepstakes. Taxes, if any, are the sole responsibility of Selected Entrant and Selected Entrant may be issued an IRS Form 1099 for the Estimated Retail Value of any awarded prize. Sweepstakes is void where prohibited or restricted by law, and subject to applicable federal, state and local laws.

Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Sweepstakes should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor's control, corrupt the administration, security or proper play of the Sweepstakes. Sponsor may prohibit an entrant from participating in the Sweepstakes or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Sweepstakes in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. Disputes regarding these Official Rules and/or this Sweepstakes will be governed by the internal laws of the State of California. Any and all legal actions or claims arising in connection with this Sweepstakes must be brought in a court of competent jurisdiction within the United States. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

PRIVACY. All personal information collected by Sponsor will be used for administration of the Sweepstakes. In addition, entrants shall receive email correspondence from, or on behalf of the Sponsor, subject to the Sponsor?s privacy policy. Sponsor uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email.
